The Contract

This is a legally binding contract for a short-term holiday hire, between the property owners of Stone Cottage, Wrexham (James and Natalie Edwards referred to as "us" or "we") and the person making the booking and all members of the holiday party (referred to as "you" or "your") under the following booking conditions. The person making this booking is responsible for ensuring all members of the holiday party, accept and adhere to these terms and conditions. UK law will govern the Contract. When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email, to the email address you provide in the booking form, this does not form a contract between us. The contract is not effective until we have received and processed the deposit or full payment (dependent on timing prior to booking commences). The contract will be subject to these booking conditions, and must be complied with. The party leader must be at least 18 years of age at the time of booking and is responsible for all other members of the party. The agreement to stay in the property for the holiday period does not create the relationship of Landlord and Tenant between you and us. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period. We reserve the right to decline bookings at our discretion. We offer holidays based on accommodation only. We do not offer package holidays.

Booking / Payment Method

The booking is taken on a provisional basis until the deposit has been paid in full and funds are cleared through the banking system.

The deposit is £100 and is non-refundable.

The outstanding balance is due 8 weeks before the holiday start date (we will send email reminders). If the balance is not paid by the deadline and no communication has been received, the deposit will be kept and the dates released.

Alternatively, if the booking is made less than 8 weeks before the holiday start date, the entire holiday cost should be paid to us.

Good Housekeeping Deposit

A good housekeeping deposit of £250 will be taken with the outstanding balance, 8 weeks prior to your stay. The Good housekeeping deposit is taken to ensure that there are monies to cover any additonal cleaning, damages or replacements that may be incurred during your stay. The deposit will be returned within 5-7 working days after your rental period has ended.

Cooling Off Period

There is a 48 hour cooling off period (from the date of the DIRECT booking confirmation) during which, if you are unable to agree to these terms and conditions you can cancel your booking by email, and we will give a full refund less a £20 administration fee.

Cancellation by you

If you change your mind or are unable to attend and would like to cancel your booking, you must contact us, via email, as soon as possible. You may be due a partial refund which is dependent on when the notice of cancellation is given to us, before the holiday start date.

8 weeks or more, prior to holiday - no refund on deposit however any monies paid in addition to the deposit will be refunded.
Less than 8 weeks (once the balance has been paid) there will be no refund UNLESS booking is resold*

*We will endeavour to re-sell your cancelled holiday booking and in that case, you will be refunded the resold booking cost (which may be lower than your original booking if the cancellation occurs within 4 weeks of holiday date) minus an administration fee of £25 which will cover associated marketing and administration costs.

We may, at our discretion, offer alternative dates for your holiday.

Refunds will be made to the original payment method.

It is your responsibility to ensure that you have adequate travel insurance in place to cover any loss or damage that you may suffer as a result of cancelling all, or part, of your stay with us and any associated costs.

Cancellation by us

If our performance is hindered or prevented by a Force Majeure Event (please see definition below), we may, at our sole discretion, offer you:
• a full refund;
• or alternative holiday dates;
• or such other remedy as we consider appropriate with regard to the circumstances.
In this contract, a Force Majeure Event, means any of the following circumstances, which may hinder or prevent the performance of the contract, including but not limited to:
• acts of God, flood, drought, earthquake or other natural disaster, epidemic or pandemic;
• terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
• nuclear, chemical or biological contamination or sonic boom;.
• any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent;
• collapse of buildings, fire, explosion or accident;
• any labour or trade dispute, strikes, industrial action or lockouts;
• non-performance by suppliers or subcontractors; and interruption or failure of utility service.
We shall endeavour to make sure the stated property is available for the dates contracted.

In the unlikely event that the property becomes unavailable and we have to cancel the booking, the holidaymaker shall be entitled to a full refund. We will only be liable to return the monies received. No compensation or consequential losses shall be paid.

Complaints Procedure

If it is felt that there are reasonable grounds for complaint about your holiday accommodation, we must be contacted immediately so that appropriate action can be taken during your stay. No such matters can be dealt with upon departure or after your return home. We value your custom and want you to return so will make every endeavour to rectify any identified problems, as soon as is reasonably possible. We value feedback on what we can do to enhance any future stays.

Liability

We accept no responsibility for any damage or injury caused by use of the accommodation and any amenities, and such use is at your own risk.

The details and prices on the website may be subject to change.

The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymaker’s party. Vehicles and possessions are left entirely at the risk of the holidaymaker.

Children and infants should be supervised at all times.

The information on our website is believed to be correct and true at the time of going to press.

We cannot be held responsible for (and cannot accept liability for) issues outside our reasonable control such as breakdown of domestic appliances, plumbing, electrical problems, structural repairs, non-working Wi-fi, poor TV reception, invasion of pests, infestations or damage caused by exceptional weather conditions, or by noise and disturbance resulting from nearby building works, noisy neighbours or local events etc.

Representation

Whilst every effort is made to ensure the accuracy of the information given, either orally or written, and all such representations are made in good faith, no such representations will create any liability on our part.

Occupancy

It is not permitted to exceed the maximum occupancy (stated in brochure & web site) for Stone Cottage, which is 6 persons. This will invalidate our property insurance.

If it is found that more people than agreed, are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund.

Sub-letting or assignation of the let is prohibited.

You must not hold events, such as parties, celebrations or meetings at the property without our prior consent. You should advise us of any changes to your group guests, prior to arrival.

Guest Undertakings

On booking Stone Cottage, the lead name on the booking confirmation becomes responsible for all members of your party and you all agree to keep the cottage clean and tidy; not to commit or allow any of your party to commit any act which breaks the law; not to use the property for any commercial or illegal purpose; not to sublet the property as a whole or any part thereof or otherwise allow anyone to stay whom we have not previously accepted and informed us as being part of your party; not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt, affect the enjoyment of or cause nuisance to any others particularly the occupants of the neighbouring properties.

Smoking

Smoking and vaping are not permitted in any part of Stone Cottage.

Smokers may smoke in the stone porch area with the front door closed.

If smoking takes place with the door open or there is evidence that smoking or vaping has occurred within the cottage, an additional, deep cleaning charge of £100 may be applied.

Dogs and pets

We don’t accept pets in Stone Cottage.

Bed Linen and towels

Bed linen, towels, bath mats, tea towels and oven gloves are provided in all of our properties. Bedding is not provided for cots and travel cots.

If you are staying in a property for 2 weeks or more, clean bed linen and towels can be provided fortnightly on request. If you require weekly bed linen and towels, a charge of £40 will be applied per weekly change.

Heating, electricity and water

Stone Cottage has recently had a brand new boiler and is a warm and toasty property and with temperatures set between 18 and 20 degrees throughout the day and night in the winter months. The utilities (oil, water and electricity) are included in the hire charge however due to the current energy prices, fair usage terms apply to electricity of a maximum of £8 per day. Electricity consumption over this amount will be removed from the deposit or charged separately. Proof of your consumption can be provided if required. If there is an issue with the heating, you must notify the Property Owners as soon as possible.

Refuse Collection

Please check the guest information for details of re-cycling points, collection dates etc.

Lost Property

We regret that we cannot accept responsibility for any lost property left behind at the end of your stay.

Please contact us within 7 days, describing what was left and where you expect it to be found, and we will try to locate it (where possible) collect, package & post back to you. There is an administrative charge of £20 for this, plus postage.

Damage

The holidaymaker should make every effort to keep the property, grounds, fixtures and fittings plus all contents in the same state of repair and condition as at the start of the holiday.

For your protection and ours, we do a full inventory before and after each guest stays including timestamped pictures. Please notify us of any damage or breakages that take place during your visit, immediately. This will allow us to make arrangements to replace the items ahead of visits by future guests.

The property owner retains the right to make an additional charge for damage and breakages.

Additional Charges

Smoking / Vaping deep cleaning charge - £100
Late Checkout (when arranged in advance) - £30 until 2pm
Late Checkout (without prior arrangement) - £100
Damages/breakages – itemised on an individual basis
Blockage of the Septic Tank - £200
Lost keys - £40
Returning lost property - £20 admin fee plus postage
Theft - an invoice requesting the amount plus a £50 administration fee will be sent to your address. If unpaid after the deadline, we will refer your invoice to a debt collector and this may affect your credit rating plus additional charges will be incurred.
Other charges may be incurred.

Arrivals and departures

Stone Cottage will be available from 3pm on the day of arrival and must be vacated by 11am on the day of departure. Please do not arrive early, or depart late (unless previously arranged), as time is needed to thoroughly prepare the property for the next customer.

Late departure will result in an additional charge of £100 being made. Information about keys/access to the property will be provided 24 hours prior to arrival.

The accommodation must be left in the clean and tidy condition in which it was found. This includes washing up, placing rubbish in bin liners and putting rubbish liners in outside bins, ensuring ovens are clean and free from grease. The cottage must be locked and the keys must be stored in the key box.

Access

You must allow us or our representative (including workmen), access to the property at any reasonable time during your occupation of the property. In cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time, we are entitled to enter the property at any time without giving you prior notice. We or our agent reserves the right to regain possession of the property in the event of a major breach of these terms and conditions. In this case, all payments made, will be forfeited and we would not be legally responsible to you as a result of this situation.

Electrical Charging Vehicle Policy

We do not have on-site charging facilities at Stone Cottage and you must make your own arrangements for EV charging. The closest charge points to the Property can be located using this website - https://www.zap-map.com/live/. Guests are not permitted to charge their EV using the property's electricity as this is a fire risk and invalidates our insurance policy. Unauthorised charging will lead to an additional payment of £100 and cancellation of your stay immediately. Please ask if you require information on your nearest charging spot.

Miscellaneous

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.

The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner’s opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.

The property owner reserves the right to refuse entry to anyone, who in the property owner’s opinion is not suitable to or capable of taking charge of the property.

The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.

Criminal behaviour including theft and drug taking

Any criminal behaviour taking place at Stone Cottage will be reported to the Police and the relevant OTA (if booked via a third party) and will result in your booking being cancelled immediately.

Please do not remove any items from the cottage. If you mistakenly remove an item, please contact the owners to arrange return. If items are removed, a charge, covering replacement of the item, including postage, time and fuel costs plus an administration fee, will be issued.

Fire

The fireplaces are decorative and not to be used for fires. Use of candles is also prohibited.

Fire extinguishers and a fire blanket are provided in the first cupboard in the kitchen along with mains fire alarms. A second fire extinguisher is located by the radiator near the bathroom on the first floor.

Parking

Driving on the grounds is not prohibited. Cars and other vehicles must remain on the stoned pathway at all times.

Parking for 3 cars is provided on the stone driveway in front of the dining room window or to the side of the property.

Damage to the grounds will be charged.

Statutory Rights

These conditions do not affect your statutory rights as a consumer.
